TERMS AND CONDITIONS OF SALE
Sydney Fish Market Pty Limited ("SFM") (incorporating the Sydney Seafood School) will provide you, the customer, with any books, equipment, knives or other goods ("the goods") you order subject to the following terms and conditions:

Subject to 4, once you place an order, you are not permitted to cancel it.
Prices for the goods are subject to alteration without notice and may be affected by stock availability, government impost (including levies, taxes and duties) and errors made in printing.
All goods must be paid for in advance by either credit card, cheque or money order made out to Sydney Seafood School.
Goods which cannot be supplied at the time the order is place, will be placed on a back order and delivered when stock becomes available. This back order facility can be overridden only upon specific request in writing by you.
SFM will use its reasonable endeavors to deliver goods to you within 14 days of receipt of your order.
Risk in all goods passes to you upon delivery.
In the case of incorrect or short delivery of goods, you must inform SFM in writing within 7 days of receipt, otherwise you are deemed to have accepted the goods.
All conditions and warranties on the part of SFM implied by law in relation to any goods supplied or to be supplied by it are excluded to the maximum extent permitted by law.
To the extent that SFM may be liable for a breach of a condition or warranty under Division 2 of Part 5 of the Trade Practices Act 1974 or other similar legislation ( other than a condition or warranty implied by Section 69 of the Act) the liability of SFM will be limited to: the replacement of goods concerned or the supply of equivalent goods; or the repair of the goods SFM's option.
Other than as provided above, SFM excludes liability in contract, tort or otherwise for any breach or any loss, damage or expense suffered or incurred by you whether direct or indirect (including, without limitation, any loss of business revenue, profits or any consequential loss) to the extent permitted by law.
